Apple Watch is injurious, say owners after filing lawsuit

In what comes as another new lawsuit for Apple, the Cupertino-based tech firm has been sued for its Apple Watch. This time, customers from Oakland, California have filed a lawsuit against Apple for designing the Apple Watch in a way that could injure its users. Those who have filed the case are victims of an incident involving the Apple Watch that slashed the arm of the user.

In the lawsuit, the customers claim that Apple has not allowed any space for the batteries to swell up once they age. As a result, the swollen batteries push up the display, making it detach or even crack. The victims claim that Apple has violated the consumer protection laws as the company had knowledge of the issue before releasing the product.

Apple Watch brings lawsuit after injurious defect

“The screens are made either of Ion-X glass (aluminium models) or sapphire crystal glass (stainless steel and titanium models) and each have a razor-sharp edge on all four sides,” the customers said.

“The detached, shattered, or cracked screens are a material and unreasonably dangerous safety hazard,” added the customers in the complaint, which was filed in federal court of Oakland, California.

The complainant has included a proof of the injury caused by this defect. The lawsuit ahs photo attached of the user's injured arm that was cuased by a cracked screen of their Apple Watch Series 3 after the battery was swollen.

The customers in the lawsuit mean to represent all Apple Watch buyers who got theirs between 2015 and 2020. Those who got the new Apple Watch Series 7 are not included.

Apple had previous knowledge of this defect. Back in 2019, when cases of cracked screen on older Apple Watch models crept up, teh company announced a free screen replacement on the Aluminum variants of the Watch Series 2 and Watch Series 3. "“Apple has determined that, under very rare circumstances, a crack may form along the rounded edge of the screen,” admitted the company at the time.
